the electors however they want. the electors for obama or for romney, but if a state wanted to the legislature could choose the electorate rather than having election. they would be voted out of office but they could do it. with those premises in place, the question is, can a state delay an election? yes but not for president. federal law has said you must choose your electors on the first monday after the first tuesday of november. this year, november 6. so the state of new jersey, where we live, for example, could delay congressional elections by a month because they felt candidates could not campaign because of the hurricane but it could not delay the presidential election since that is the date set by congress. so, we have to hold it on that date or hold a substitute for it, like a vote if the legislature on that date. >>neil: what is the likely hood that 20 states, says were affected by the storm in one way, shape or form, not that the entire state is affected by power outages and it is mostly in new jersey or connecticut or the other states is there anything the federal gover

federal aid. when the second disaster happened, romney and the state had money sitting in the until because people were evacuated. he refused to spend the state's money even though they had a surplus because he wanted to know what the federal government was going to give him first. he didn't think it was a moral hazard to wait for the federal government to write a check before he spent massachusetts's own money and he wound up refusing to help families in lower massachusetts who were really hurting and he refused to spend the state's money to help them. so what is the actual moral hazard here? >> steve, if it was at least a month left in the campaign i have no doubt team obama would have an ad out, at least a week or two from now, with this fema response, including disaster relief. everything would be in that ad. and but now with the election coming on tuesday, it's difficult to see how team obama cuts that ad and gets it out there in a way people don't think are overly exploiting the situation. >> my guess is they wouldn't touch that from here to the election. if you look at the po

president romney want to do away with fema and ship those resources back to the states? do we know for sure? >> yea. absolutely. he's not opposed to that by any means. i think what the governor is talking about and we've seen cases in the past is trying to make sure that fema is the most effective agency possible in terms of affecting states and localities with disasters and it's always been a major concern in the sense that the way that it is budgeted for is not one in which it is reliable or one that states can depend on, so looking at how we fund fema and how those activities are streamlined to help states and again, you look back several storms and there's a lot of criticism to fema, so getting to an agency, allowing an agency to operate more effectively and ensuring states and localities are receiving the funds they need to help the people is what this comes down to. >> thanks for taking time for us this morning. we appreciate it. >> thanks, tom. >> we are just learning that president obama will be holding ab11:45 a.m. eastern call with mayors and governors affected by sandy. we'l
